01. GENERAL INFORMATION

When you make a purchase on www.jamesay.com, you accept the terms and conditions below.
If you experience problems with your order on the website or the general use of the website, please contact us on firstname.lastname@example.org or +45 71993023. On www.jamesay.com we sell high premium sunglasses.
To make a purchase on www.jamesay.com, you must be 18 years old and have a valid payment card that we accept. If you are not 18 years old, you can still make a purchase, but you must be granted permission from a parent or a legal guardian.
02. PLACING AN ORDER
If you are under the age of 18 and you make a purchase without permission from a parent or a legal guardian, James Ay ApS disclaims all responsibility, as it is stated above that the purchaser must be 18 years of age or have a parent’s or a legal guardian’s consent to make a purchase on www.jamesay.com.
When you place an order at www.jamesay.com, you submit some basic information, including your name, billing address, delivery address, e-mail address and phone number.
James Ay ApS stores your information in accordance with our personal data policy. Immediately after submitting your order, you will receive an order confirmation. When we have accepted your order, you will receive an invoice on your e-mail, which constitutes a binding agreement between you and James Ay ApS. For your information, the order confirmation is not an invoice and the purchase is not final before you have received an invoice from us. Please check your spam folder to ensure that our mail has not been filtered.
03. PRICES & PAYMENT
When shopping at www.jamesay.com you will get information about the price in total including delivery costs before you reach the final confirmation.
All prices indicated on www.jamesay.com are inclusive danish vat, which is currently 25%.
We reserve the right to change prices without notification due to increased costs or as a result of a general development in retail prices.
You can use the following payment methods when shopping on jamesay.com: Credit card and Paypal.
We receive the following payment cards: Visa, MasterCard and Paypal.
If we suspect a fraudulent payment, then we reserve the right to cancel the order or ask for a personal picture id together with the last four digits on the credit card used for the payment. All your account details are encrypted and transmitted through a secure payment method. We use psp payment as our certified partner. Your card will be debited once we have shipped your order from our warehouse.
We use DSV (GLS, UPS and FedEx) and Postnord as a courier to ship your parcel.
In some countries, you only have one of the following delivery options:
4.1. delivery to your work address.
4.2. pick it up at a parcel shop near you.
4.3. delivery to a private address. Please note that if you permit it to be placed somewhere, James Ay ApS disclaims all responsibility in regard to a possible loss or damage. if you did not fill out the note on where to leave it and are not home at the time of arrival, it will be left in a parcel shop or a depot near you.
All orders are shipped within 48 hours on working days with Postnord (Denmark) or DSV (GLS, UPS or FedEx / Rest of the world). Delivery time to all EU countries is 1-5 working days and 2-8 working days to the rest of the world. Once you have received the package, you should inspect the goods. If the package and/or contents are damaged, please immediately contact us.
On your invoice, there is a track and trace number that you can use to track your package on the courier's website.
We only show products that are in stock, but should we, for some reason, not be able to deliver your product or should the product be delayed for other reasons, we will let you know as soon as possible.
To return an item, you must inform us within 14 days after you have received your product. To notify us about a return, contact us by mail at email@example.com. The money will be refunded to the card used when ordering. Unfortunately, we can not exchange it for a different style or colour.
Refusal to receive a package upon arrival is not qualified as a rightful return, and we reserve the right to charge you an amount to cover any additional costs that we may have in regard to your withdrawal. You must ship your product no later than 14 days after you have contacted us requesting a withdrawal. If the deadline, however, is a public holiday, a Saturday or a Sunday, the new date will be the following working day.
James Ay ApS is not paying for the return order.
When you send your package back to us, you must include the invoice with the order number and mark it outside with CVR 39110822 and that it's a return order.

Unfortunately, it is not possible to neither return nor exchange your product in physical stores.
Customers outside Europe: Remember to mark outside on the return order the following information: Return order, James Ay ApS, Cvr. 39110822.
Please note that it can take 1-5 days for us to process your return and refund the amount corresponding to your order after receiving it. Remember to get the tracking number from the post office.
Please note that you are liable for any decrease in value if you have tested or used the product in ways other than those usually allowed in-store. When we receive the product, we will assess the condition and refund you the amount corresponding to the item’s condition.
06. YOUR RIGHTS AS A CUSTOMER
According to danish law, you are covered by a legal two-year manufacturing guarantee.
If you wish to make a complaint, you must do so within a reasonable time frame and latest, within two months.
If your complaint regards a defect in a product, we advise you to contact us at firstname.lastname@example.org as soon as you have found the defect to shorten the processing time for your claim.
If we assess the claim to be justified, we will refund any costs you may have had in regard to sending the product back to us.
In the case that we cannot justify the claim, the shipping expenses are on your own account. We recommend you send the product safely and get a receipt. the responsibility for the package lies with you until we have received it. It is, therefore, advisable to save a receipt with the shipping charges and a track and trace number, if possible.
07. DISCLAIMER OF LIABILITY
James Ay ApS does not make any warranties in regards to the accuracy of the information on the website and neither has no liability if products are sold out. That said, we do, naturally, attempt to make the content and material on the website correct up to date and in compliance with respective laws. If you find any information to be irregular, you are always welcome to contact us.
We can furthermore change the content on the website at any time and we are not entitled to give you preceding notice of this. We, therefore, suggest you revise our terms and conditions when you use our site.
James Ay ApS is neither liable for any loss nor damage from the use of the website.

All the elements on the website are protected by copyright and are the property of James Ay ApS. The information can, therefore, only be used with permission from James Ay ApS.
If we link to a third-party website, James Ay ApS cannot make any guarantees nor be held liable for the content posted on the third-party website.
We merely provide the links for your utility, but if you visit a third-party website, it is at your own risk.

We treat your personal data confidentially. Please read our privacy data policy that explains how we use the personal data that you provide in connection with the ordering procedure, and your use of the website in general.
9.1 the object of our personal data policy is to explain how we collect, protect, use and store your personal information.
9.1.1 what information does James Ay collect about you?
We collect your first name and surname, postal code and city, address, e-mail, phone number and your order history.
We only use your personal information to grant you access to the products provided on www.jamesay.com and to execute any orders you may place with us. As we are required to meet the accounting legislation, we store your billing information for a period of five years from your latest order.
If you subscribe to receive our newsletter, you accept our personal data policy. remember that you can unsubscribe from the newsletter at any time.
9.1.2 how does James Ay protect your information?
We respect your privacy and we take it very seriously, which is why we make various efforts to ensure your information, one of which is to store it on secure networks. We are further not able to see your payment card information, as all data are encrypted and the transactions are conducted through certified partners.
9.1.3 Does James Ay share your information with others?
The information you share with us is treated confidentially. Though, we ask you to note that we share some of your personal information with relevant third parties. to deliver your package, we provide our courier with the necessary details, hereunder your first name, surname, postal code, city, address, e-mail address and your phone number.
9.1.4 What does James Ay use your e-mail and phone number for?
We use your e-mail to send you a confirmation of your order and if you have signed up to receive our newsletter, you will also receive this on the e-mail address you have provided us with.
In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.
If you wish, you can easily erase cookies from your computer or mobile device. However, please note that if you choose to disable cookies, you will not be able to take advantage of all features on our website.

You may also submit a complaint about goods purchased from us to the Danish Dispute Resolution Institute, Carl Jacobsens vej 35, 2500 Valby, Denmark. it is also possible to submit a complaint online via www.forbrug.dk.
You may also use the European Commission online complaints register when submitting your complaint. this is particularly relevant if you are a consumer residing in another eu country. you may submit the complaint by using the following link: http://ec-europa.eu/odr. In case we cannot reach a settlement through the danish dispute resolution institute, you will have access to submit a complaint to the consumer complaints board. 11. CHOICE OF LAW AND DURISTICTION
Any contracts concluded between us using these terms and conditions are governed by danish law. Any dispute which may arise in connection with our contract, including its existence or validity, must be brought before a competent court in Denmark. As a consumer you may bring proceedings against us in the courts for the place where you are domiciled.
